Following the running of Race 7, J L E Equine Dentists Trot, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against LIFEOFTHEPARTY (A M Butt), placed 3rd by the judge, on the grounds of “breaking from its gait in the run home in excess of 50 metres”.

Following the running of Race 7, J L E Equine Dentists Trot, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against LIFEOFTHEPARTY (A M Butt), placed 3rd by the judge, on the grounds of “breaking from its gait in the run home in excess of 50 metres”.

Mr A M Butt was present at the hearing of the protest and indicated that he represented the connections of LIFEOFTHEPARTY.

Mr Butt acknowledged that, if the horse had galloped for a distance in excess of 50 metres, it had to be disqualified but he said the issue was the distance over which it did gallop, which was for the Committee to decide.

Mrs Williams showed video replays of the final 100 metres of the Race. She pointed out the 50 metres marker on the inside of the track and alleged that LIFEOFTHEPARTY had galloped prior to that marker.

Mr Butt argued that the horse had galloped so close to the 50 metres marker that it was not possible to be certain that it was before the 50 metres. It “went a bit rough” before it galloped, he said. If it was after the 50 metres, the horse deserved to keep its placing because it lost ground immediately and was well clear of the 4th horse (1¼ lengths). Mr Butt said that he had restrained the horse immediately and it was not lapped on. Any doubt had to go in the horse’s favour, he submitted.

Whilst it was clear that LIFEOFTHEPARTY had broken from its gait within the final 200 metres of the Race, the Committee was not satisfied, from the evidence, that LIFEOFTHEPARTY had continued on in a break for a distance of 50 metres or greater in breach of the Breaking Horses Regulation. There was sufficient doubt, and the video replays were not conclusive in the Committee’s view, as to whether the horse had breached the Regulation and, accordingly, the protest was dismissed and the judge’s placings in the Race stand.
