Information No. 67858 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr D J Simpson, alleging a breach of Rule 865 (2) in that he “failed to submit a notifiable gear form in [sic] by the required time of 1 pm 8/4/09 (driver notification time) for FLYINGBOYZ”.
--Mr Simpson had signed the Statement by the Defendant on the information form indicating that the breach was admitted and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Rule 865 provides as follows:
(2) A horse may race with different gear from its last start when the owner, trainer or person in control of the horse has notified the change in the manner prescribed in the Approved Gear Regulations. Any such change is to be advised not later than the official time for notification of drivers as specified in the Notification of Drivers Regulations.
Mr Renault informed the Committee that FLYINGBOYZ had been paraded prior to Race 3 in earplugs. This was a change of gear that was required to have been notified by 1.00pm on Wednesday, 8 April 2008 being the official time for notification of drivers for the meeting. Mr Simpson had not been aware of the requirement to notify, Mr Renault said.
--Mr Renault recommended a fine of $50.
Mr Simpson was fined the sum of $50.
