Information No. 67823 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr W E Higgs, alleging a breach of Rule 865 (2) in that he “failed to submit a notifiable gear form by the required time of 1 pm 8/4/09 (driver notification time) for NOBLE GALLEON and failed to advise on a gear form of the removable hood that COQ D’OR wore”.

Information No. 67823 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr W E Higgs, alleging a breach of Rule 865 (2) in that he “failed to submit a notifiable gear form by the required time of 1 pm 8/4/09 (driver notification time) for NOBLE GALLEON and failed to advise on a gear form of the removable hood that COQ D’OR wore”.
--Mr Higgs had signed the Statement by the Defendant on the information form indicating that the breach was admitted and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Rule 865 provides as follows:
(2) A horse may race with different gear from its last start when the owner, trainer or person in control of the horse has notified the change in the manner prescribed in the Approved Gear Regulations. Any such change is to be advised not later than the official time for notification of drivers as specified in the Notification of Drivers Regulations.
Mr Renault stated that it had been observed in the birdcage prior to Race 7 that NOBLE GALLEON was wearing half blinds and that COQ D’OR was wearing a removable hood, neither of which had been notified as required.
--Mr Renault recommended a fine of $50 in respect of each horse.
--Mr Higgs was fined the sum of $100.
