Information No. 67819 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainers, Messrs M Purdon & G A Payne, alleging a breach of Rule 865 (2) in that they “failed to submit a notification of gear form by the required time of 1 pm Wednesday 8th April (driver notification time) for MILLWOOD MEG, [Non-Tote], MILLWOOD TRIX [Race 3], CASARINA [Non-Tote] and LIFEOFTHEPARTY [Race 7]”.

Information No. 67819 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainers, Messrs M Purdon & G A Payne, alleging a breach of Rule 865 (2) in that they “failed to submit a notification of gear form by the required time of 1 pm Wednesday 8th April (driver notification time) for MILLWOOD MEG, [Non-Tote], MILLWOOD TRIX [Race 3], CASARINA [Non-Tote] and LIFEOFTHEPARTY [Race 7]”.

Mr M Purdon had signed the Statement by the Defendant on the information form indicating that the breach was admitted and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 865 provides as follows:
(2) A horse may race with different gear from its last start when the owner, trainer or person in control of the horse has notified the change in the manner prescribed in the Approved Gear Regulations. Any such change is to be advised not later than the official time for notification of drivers as specified in the Notification of Drivers Regulations.

Mr Renault informed the Committee that Mr Purdon had handed his Notification of Gear forms to the Stewards 10 minutes prior to the start of the Non-Tote race (4.40 pm).The changes were required  to have been notified by 1.00pm on Wednesday, 8 April 2008 being the official time for notification of drivers for the meeting.

Mr Renault recommended a fine of $50 per horse – a total fine of $200.
Messrs Purdon & Payne were fined the sum of $200.
