Facts:
Mr Ydgren alleged that Mr Cox used his whip outside the confines of the sulky and struck the sulky disk on 2 occasions in the run home when driving PURE CHRISTIAN in race 5, the MOSGIEL MOTOR COURT PACE.
Submissions for Decision:
Mr Ydgren demonstrated on the videos that shortly after PURE CHRISTIAN straightened up for the run home Mr Cox gave the outer sulky disk 2 flicks with the whip.
Mr Cox explained that he was trying not to use the whip on the horse as it did not respond to the whip and was hoping the noise when the whip hit the disk would encourage the horse to try harder.
Submissions for Penalty:
Mr Ydgren referred to the case of RIU v M, which was a recent similar incident. The fine on that occasion was $150 and he submitted a fine of a similar amount was appropriate.
Mr Cox did not disagree with this submission.
Reasons for Penalty:
We are satisfied that Mr Cox has hit the sulky disk twice. These actions while not forceful were deliberate. Mr Cox is an experienced horseman and should be aware of what he is entitled to do and not to do under the Rules. He has admitted the breach and has no previous breaches of this Rule.
