DECISION & REASON
--Under Rule 869 (2) (a) Stipendiary Steward Mr C J Allison alleged that "Mrs K L Barclay, horseman of CARL BRASHEAR, used her whip in an excessive manner over the final stages."
--Mrs Barclay admitted the breach but chose to be present at the hearing. Video evidence was shown. It showed Mrs Barclay hit the horse 34 times over the final stages without a break.
--Mrs Barclay explained that the trainer said the horse was very lazy and had to be driven thus. Also, CARL BRASHEAR only went under by a nose.
--Mr Allison quoted the decision in the M J Enright case where it was found that even if a horse had an inherent deficiency it still must be driven/ridden within the rules. Mrs Barclay acknowledged that 34 strokes was excessive in normal circumstances.
--Under Rule 1111 (i) (d) I find the charge proved.
--PENALTY
--Submissions as to penalty were heard. Mr Allison said Mrs Barclay had no charges under this rule in the past 12 months, but on the other hand 34 was a high number of strokes. Mrs Barclay said she preferred a fine.
--I fine Mrs Barclay $250.
