Facts:
At the conclusion of Race 10, the BIDVEST MOBILE PACE, an information was lodged by Mr Allison, Stipendiary Steward, under r 870(4)(a) alleging BELKMYSTER (Mr D Dunn) which was placed 4th by the Judge broke in excess of 150 metres over the early stages.
Judge’s placings were:
1ST 7 THE WRATH OF ROBYN
2ND 5 BILLY THE BUS
3RD 9 BETTER TO BE BAD
4TH 1 BELKMYSTER
5th 3 ALTA CAPONE
Rule 870(4) provides:
Any horse which breaks from its gait in any race and (a) which fails to promptly regain its proper gait … may (in addition to any other penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horse Regulations made by the Board, be placed by the Judicial Committee immediately after any other horse in respect of which any advantage may have been gained.
Both Mr Dunn and Mr Anderson, the driver and trainer of BELKMYSTER respectively, indicated that they did not contest the protest.

Mr Allison demonstrated on the video that just prior to the winning post on the 1st round BELKMYSTER broke from its gait and continued in a gallop for some 175 metres.
Reasons for Decision:
The Committee is satisfied that BELKMYSTER galloped in excess of 150 metres over the early stages of the race and thus has not promptly regained its gait. In these circumstances the horse is disqualified from 4th placing.
