Decision: Mr Allison, stipendiary steward, laid an information after race 9 alleging that contrary to rule 869(3)(b), Mr Stratford, driver of HOTSHOTROCKET drove carelessly
Mr Allison, stipendiary steward, laid an information after race 9 alleging that contrary to rule 869(3)(b), Mr Stratford, driver of HOTSHOTROCKET drove carelessly when allowing his horse to drift inwards onto WHYTHEHELLNOT (N McGrath) causing that horse to break and lose its chances. As Mr Stratford has admitted the breach I find the charge proved.
--Mr Knowles demonstrated on the videos that Mr Stratford had allowed HOTSHOTROCKET to drift inwards coming into contact with WHYTHEHELLNOT, which broke. Mr Stratford has admitted that he heard Mr McGrath yelling immediately prior to the contact and that he endeavoured to take corrective action. I take this into account as a mitigating factor but unfortunately the interference was caused as Mr Stratford’s actions were too late. Mr Stratford has an excellent record prior to 3 weeks ago when a breach of the Rules in similar circumstances was proved.
--I believe the matter, as Mr Allison and Mr Stratford have both suggested, can be dealt with by way of a fine. The breach is, as Mr Allison said, low to mid range. I take into account Mr Stratford’s admission of the breach. I fine him the sum of $375 and remind him of his obligations under the Rules of Harness Racing. A further breach is most unlikely to be met by a fine.
