Facts:

Mr Tidmarsh, Stipendiary Steward, alleged that in race 10, the HAPPY BIRTHDAY ALEX CAYFORD CLAIMERS MOBILE PACE CLAIMERS 4YO+ 1700 metres, Mr Orange (AYMAR) moved inwards resulting in his sulky protruding inside the marker line.
 
Rule 869(7A)(b) states:
(7A) Every horseman who moves inwards shall ensure: (b) that any part of the sulky does not protrude inside the marker line.
 
Mr Orange admitted the breach and indicated to the Stipendiary Stewards that he did not wish to attend the hearing.
 
Mr Tidmarsh demonstrated that the respondent was in the trail turning into the home straight and, as the field straightened for the run home, his horse shifted inwards and inside 2 track markers. Mr Tidmarsh stated Mr Orange had simply moved too soon, as he was always going to get a run to the inside of the leading horse, driven by Mr D Dunn. Mr Orange had simply needed to be more patient. When asked to estimate the extent to which the horse’s cart had gone inside the markers, Mr Tidmarsh said it was no more than 6 inches to a foot.

Mr Tidmarsh produced the respondent’s record which showed no previous breaches of this rule this season.

Reasons for Penalty:

The JCA Penalty Guide recommends a starting point of a fine of $200. Given the nature of the breach, the respondent’s very good record under this rule having regard to the fact he is one of the country’s busiest drivers, and his admission of the breach, a discount of $50 is afforded to Mr Orange.
