Stipendiary Steward Mr P T Knowles alleged that Mr J R Bennett, driver of THE MERCENARY, drove carelessly by crossing over from barrier 5 causing tightening to STARGLO HANOVER, driven by D J Butt, and OUR RICKI driven by B Barclay, with resulting interference to SMOOTH OPERATOR, driven by C T Woodward which broke for several strides.



Stipendiary Steward Mr P T Knowles alleged that Mr J R Bennett, driver of THE MERCENARY, drove carelessly by crossing over from barrier 5 causing tightening to STARGLO HANOVER, driven by D J Butt, and OUR RICKI driven by B Barclay, with resulting interference to SMOOTH OPERATOR, driven by C T Woodward which broke for several strides.

Mr Bennett admitted the charge and chose to be present at the hearing.

Video evidence was shown and confirmed the incident had occurred as presented by the Stipendiary Steward.

Under Rule 1111 (1) (d) I find the charge proven.

Submissions as to penalty were heard.  Mr Knowles said that Mr Bennett had held a Graduation Licence this season and although the interference was minor it could have been more serious if the other drivers involved in the incident had not been good drivers.  He suggested a fine of about $300.

Mr Bennett thought that was expensive after an incident he had been involved in up north and also said he would prefer a suspension.  Mr Knowles said a 2 or 3 day suspension was required.

Taking into account his lack of driving experience and ready admission of the breach, I suspend Mr Bennett’s licence for 3 days – up to and including the Timaru meeting on Sunday 14th September 2008.
