Facts:

Mr Allison alleged that ZARA P (Mr McIlwrick) shifted ground inwards with approximately 300 metres to run, causing a check to HOT TODDY and LAST ONE VC.

Judge’s placings were:

Submissions for Decision:

Mr Ydgren demonstrated on the various video angles that with some 300 metres to run ZARA P, which was racing 3 wide, hung inwards causing a check to HOT TODDY which was racing on the outside of WAIHEMO CAESAR. HOT TODDY galloped for a few strides before picking itself up and running on strongly for 5th. Mr Allison stated that the incident occurred as Mr McIlwrick was releasing the removable gear on ZARA P.

Mr Golding gave evidence that there was tightening from the horse on his outside, which he identified as ZARA P. He said the horse on his inside had shifted out slightly and this had contributed to the tightening but it was primarily due to movement from ZARA P. He said ZARA P had come into contact with the off front leg of HOT TODDY. He said he had been restraining HOT TODDY prior to the incident and had been calling to Mr McIlwrick to give him room. He confirmed to Mr Allison that HOT TODDY had not contributed to the tightening and that the horse was going well at the time of the interference.

Mr Dunn spoke on behalf of Mr Golding and said the horse on Mr Golding’s outside (ZARA P) was getting in on HOT TODDY and that Mr Golding had had to take a hold.

Mr Armour, trainer of ZARA P, alleged that HOT TODDY should not have been where it was on the track, alleging that the horse had earlier got a run contrary to the rules by moving off the fence. He also pointed out that there was outwards movement from WAIHEMO CAESAR.

Mr Williamson, assisting Mr McIlwrick, said there was pressure from the outside and HOT TODDY was obviously checked. He questioned whether this was due solely to Mr McIlwrick or whether there were mitigating factors in that there was a lot happening in the race at the time.

Reasons for Decision:

We accept that there had been an earlier incident in the race, which had disrupted the field but we do not believe it has any direct bearing on this protest. We believe HOT TODDY, at the time it received interference, was then in a position in the field to which it was entitled.

In exercising our discretion and relegating ZARA P to behind HOT TODDY, we are satisfied that ZARA P was hanging inwards and, when Mr Ilwrick activated the removable gear, the horse moved down on the track and came into contact with HOT TODDY. The consequence was that that horse galloped for about 10 metres before balancing and finishing on strongly for 5th. There was very slight outwards movement from WAIHEMO CAESAR immediately prior to the incident but we are satisfied the principal reason HOT TODDY was tightened for room was the inwards movement from ZARA P.
