Facts:
Mr McIntyre, Co-Chief Stipendiary Steward, alleged that in race 5 the Major General Sir Andrew Russell Trot, Mr Ryan, GOLDEN GATE, used his whip a manner that the stewards deemed to be excessive.
Mr McIntyre demonstrated that the respondent used his whip 20 times in the straight in a continuous manner. He pointed out there was no respite for GOLDEN GATE for a distance of some 150 metres. Mr Ryan only ceased using the whip as the horse neared the winning post when he had to take corrective action as the horse ducked in.
Mr Ryan admitted the breach and indicated he did not wish to be present at the hearing of the information.
