As the breach was admitted, it is found to be proved.

Mr Anderson is fined the sum of $250.

Facts:

Mr McIntyre, Co-Chief Stipendiary Steward, alleged that in race 2 the Captain Edmund Howard Junior Drivers Mobile Pace Mr Anderson shifted outwards in a careless manner near the 900 metres, which caused interference to RATTLING THUNDER.

Mr Anderson, after being advised by Mr D Dunn, Open Horseman, admitted the breach and indicated he did not wish to be present at the hearing of the information.

Mr McIntyre demonstrated on the videos that TAIERI WINGS, driven by Mr Anderson, was 4 back on the fence and just before the 900 metres mark he made a move to be one out. He then shifted ground wider on the track and in so doing his wheel came under the cart of Mr B Williamson, RATTLING THUNDER. Their carts locked wheels and they both lost ground before they were disentangled. ONE OUT OF FOUR, Mr Close, was also inconvenienced as the two horses drifted back.

Mr McIntyre produced the respondent’s record which showed 71 drives this season and 57 last season. He had no previous breach of this rule. Mr McIntyre submitted a fine in the vicinity of $250 was appropriate.

Reasons for Penalty:

The outwards movement by the respondent was sharp and the locking of wheels cost both horses their chances in the race. The breach is thus mid-range.

Mr Anderson’s record is very good and he has admitted the breach. From a starting point of a fine of $400, as recommended in the Penalty Guide, a $150 deduction is made for these factors.
