Mr Williamson admitted the breach and indicated that he did not wish to be present at the hearing.

We thus find the breach to be proved.

Penalty:

Mr Williamson is fined the sum of $300.

Facts:

Mr Allison, Stipendiary Steward, alleged that with approximately 1000 metres to run in race 1, the Dunedin City Ford Trot, Mr Williamson shifted ground inwards when insufficiently clear of QUEEN MARY, causing that horse to break.

Mr Allison demonstrated the incident on the videos, which showed that the respondent had shifted ground on the apex of the bend at the end of the home straight with a lap to race when not clear of QUEEN MARY. He came into contact with that horse causing it to break.

Submissions for Penalty:

Mr Allison described the breach as a misjudgment. QUEEN MARY was continuing to over-race and Mr Williamson was almost clear when he shifted ground, as the driver of QUEEN MARY had himself commented. An aggravating factor was the fact that MR MAJESTIC had been relegated from second and the chances of two horses, QUEEN MARY and HOPE AND PRAY, were clearly affected.

Mr Allison produced Mr Williamson’s record, which he submitted was second to none. In the last calendar year Mr Williamson had had 884 drives and had no breach of any rule. He submitted a fine of $300 was appropriate.

Reasons for Penalty:

We agree with Mr Allison’s description of the breach. It is clearly a misjudgment by Mr Williamson, who is obviously unaware that QUEEN MARY is still racing on his inside when he shifts over to the pylons on entering the bend. That said, there is no evidence on the videos of Mr Williamson looking before he moves ground inwards.

The usual starting point as provided in the Penalty Guide is a fine of $400. We raise this by $100 due to the fact that there has been a relegation and the chances of two horses were irreparably affected.

Mr Williamson has admitted the breach and his record is excellent. These mitigating factors merit a $200 discount.
