Facts:
Following the running of race 1, Just Essence Catering Trot, an Information Instigating a Protest was filed pursuant to Rule 870(3). The Informant, Stipendiary Steward, Mr S Renault alleged that 4th placed SOUTH COASTER (S Golding) broke in excess of 50m in the home straight.
Judge’s placings were:
1st – Sundon Invasion (5)
2nd - De Vito (10)

5th - Scottie Trouble (8)
Rule 870(3) provides: "that any horse that breaks from its gait shall be promptly returned to its gait."
The Breaking Horse Regulations (part B) provides: "any horse which breaks from its gait in the final 200 metres of any race and continues on in a break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its gait."
The Regulation further provides: "where a protest has been duly lodged against the placing of an offending horse, The Judicial Committee shall either: (1) relegate such horse under Rule 870(4) to behind any other horse in respect of which an advantage may have been gained; or (2) disqualify it from the race under Rule 1003(2)".
Submissions for Decision:
Mr Quirk demonstrated the incident using the side on video. He stated that SOUTH COASTER trailed to the turn before entering the Passing Lane. Approximately 200m from the finish, SOUTH COASTER broke from its gait and continued in a break in excess of 100m.
Mr Renault stated Mr Golding had made every attempt to return SOUTH COASTER to its proper gait. He sought the disqualification of SOUTH COASTER in accordance with the Breaking Horse Regulations.
Mr White, representing the connections, advised the Stewards he did not contest the protest.
Reasons for Decision:
The Committee after viewing the video footage are satisfied that SOUTH COASTER broke from its gait in excess of 100 metres in the final 200 metres and was therefore in breach of the Breaking Horses Regulations and Rule 870(3) in that it has failed to promptly regain its proper gait.
