An Information was laid by Stipendiary Steward, Mr C J Allison under Rule 869(3)(B), alleging that in race 9 The Forbury Function Centre Mobile Pace that just short of the winning post A J Shand, (MIGHTY MEMORIES) shifted ground outwards checking TOLERATE (A R Beck).

An Information was laid by Stipendiary Steward, Mr C J Allison under Rule 869(3)(B), alleging that in race 9 The Forbury Function Centre Mobile Pace that just short of the winning post A J Shand, (MIGHTY MEMORIES) shifted ground outwards checking TOLERATE (A R Beck).
--Mr Alan Shand admitted the breach and has assistance from Mr Gary Shand the trainer of MIGHTY MEMORIES throughout the hearing.
--Mr Allison used several video clips of the alleged incident stating that in his opinion Mr Shand had made an error of judgment, and that he has moved outwards when not sufficiently clear of CAMSPLACE DEXTER (Mr Malcolmson). Mr Alan Shand said that he had thought Mr Malcolmson was behind Mr Beck (TOLERATE) but clearly he was not, and that he had made an error judgment, moving out when he did, causing interference to both horses.
--SUBMISSIONS ON PENALTY
--Mr Allison stated that he believed the breach of the rule was at the lower end of the scale, and that a fine would be appropriate.
--Mr Alan Shand stated that he would prefer a suspension, as he was a junior horseman and was not in a financial situation to easily repay a fine.
--Mr Shand had up to two drives on a raceday or night, and was attached to small race team. Mr Shand also stated the he was shortly to join the stable of Graham and Paul Court (West Melton).
--Mr Allison also confirmed that Mr Shand had not been in breach of this rule within the past twelve months.
--DECISION ON PENALTY
--Clearly a breach of the rule had occurred and the committee was satisfied that the breach was at the lower end of the scale.
--Mr Shand was given credit for his guilty plea and for his excellent driving record over the past twelve months.
--Mr Shand was suspended from driving up to and to the conclusion of racing on Thursday 11 June 2009.
