Mr Campbell is suspended from driving from the end of the meeting on 4 April up to and including 13 April and is also fined the sum of $100.

Facts:

Following the running of Race 9, the NEXT RACE MEETING 4TH APRIL MOBILE PACE, an information was filed by Stipendiary Steward, Mr Renault, alleging that Mr Campbell drove carelessly, by allowing NO MORE CHANGE to shift down and make contact with VIGOROSO causing the horse to break.

Mr Munro, Stipendiary Steward, demonstrated the position of the 2 horses concerned on the track some 300 metres after the start. Both were near the rear of the field and Mr Campbell shifted ground inwards making contact with the hind leg of VIGOROSO. That horse broke and galloped out of the race.

Mr Renault said Mr Campbell was entitled to shift inwards and to ease VIGOROSO down but it had to be done in a slow and gradual manner. On this occasion he had not allowed Mr Simpson time to move down the track.

Mr Campbell said he had gone to ease Mr Simpson down and his horse had shifted down a bit quicker than expected. There had been a gear change from a pole to a pricker, and he believed this had contributed to the horse shifting quicker than he had anticipated.

Mr Cox said the error that Mr Campbell made was the speed with which he moved Mr Simpson down. He said Mr Campbell was unlucky in that had the carts been wheel to wheel he may have got away with the move.

Submissions for Penalty:

Mr Renault produced Mr Campbell’s record. He has had 30 drives last season and 36 this season. His record is clear under all rules for the past 12 months.

It was agreed that Mr Campbell drives on average in 2 races per meeting. Mr Renault submitted a penalty of 3 to 4 meetings was appropriate, based on the 10-drive starting point in the Penalty Guide. He said the consequence of the breach was that one horse was taken out of the race.

Mr Campbell submitted that his excellent record should be taken into account and sought a deferment until after racing at Forbury Park on 4 April. Mr Renault did not object to this. Mr Campbell also stated he preferred a fine to a suspension and asked the Committee to give consideration to this.

Reasons for Penalty:

The breach is mid-range. Mr Campbell simply tried to shift Mr Simpson down too quickly. As Mr Renault stated, VOGOROSO’s chances in the race were extinguished by Mr Campbell’s actions. An uplift to 12 drives is appropriate for this factor, having consideration to the gear issue that Mr Campbell has raised. After taking into account the admission of the breach, Mr Campbell’s status as a junior driver and, of course, his excellent record, the Committee reaches an end point of a 6-day suspension. This is 3 days. The last day of the suspension is Forbury Park where there are 2 junior driver races. It is in the interests of Mr Campbell that he is able to drive as frequently as is appropriate having regard to the need to uphold the integrity of harness racing through the imposition of the appropriate penalty. In these circumstances, the Committee is prepared to substitute one day with a fine of $100 (which is the equivalent to 2 drives, as provided in the Penalty Guide).
