Facts:

Following the running of Race 5, the NORWOODS FARM MACHINERY MOBILE PACE, an information was filed by Stipendiary Steward, Mr Renault, alleging that Mr Dunn, the driver of DONEGAL CARRICKFIN used his whip on more occasions than is permitted by the Use of the Whip regulations.

Mr Dunn signed the information indicating that he admitted the breach and did not wish to be present at the hearing of the Information.

Rule 869 provides as follows:

(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

The Use of the Whip Regulations provide:

(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Renault demonstrated on the race films that the respondent, who was racing in the one/one at the 400 metres, shifted out for a run in the home straight and used his whip 13 times. There were 3 strikes with his left hand and then another 10 with the right, some of which were backhanders. There was some respite when the whip was pushed through the tail.

Submissions for Penalty:

Mr Renault produced Mr Dunn’s record. He has had 360 drives this season and his record is clear under this rule since 24 June last year. In that time Mr Dunn has had 398 drives, so a reset applies.

Reasons for Penalty:

The breach is low-range. The Penalty Guide provides a penalty for a first breach of $200 in these circumstances.
