Facts:
An information was filed by Stipendiary Steward, Mr Renault, against Mr Alford, the driver of AY BOY in race 7, the FORBURY PARK JUNIOR DRIVERS MOBILE PACE alleging that he used his whip on more occasions than is permitted by clause (b) of the Use of the Whip Regulations.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.
The Use of the Whip Regulations provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Alford admitted the breach and did not wish to be represented by a senior horseman.

Mr Renault demonstrated on the videos that the respondent used his whip 12 times in the final 400 metres. There was the odd pause and over the last 50 metres Mr Alford pushed the whip through the tail. Mr Renault noted that Mr Alford had used alternative actions and had simply not broken the strikes up enough.
Mr Alford confirmed this and agreed he had pushed the whip through the tail towards the finish of the race. He said he had not been counting. He would do so from now on.

Mr Renault produced the respondent’s record. This evidenced 47 lifetime drives. These were all this season, as this is Mr Alford’s first one driving. The respondent has no previous breaches of the whip rule. Mr Renault submitted that a penalty of a $200 fine is appropriate.
