Mr Knowles instigated a protest against FRANCO TEMPLAR placed 4th by the Judge in race 5 on the ground that the horse moved inside the marker pegs in the home straight thereby gaining an advantage. Judges placings were: 11; 12; 7; 10; 1; 4.

--Mr Allison, stipendiary steward, demonstrated on the video that in the home straight FRANCO TEMPLAR went for a run on the inside of FIERY TART (Mr May) and, in so doing, ran over 2 marker pegs.
--Mr Davis, on behalf of Mr McDowell, said Mr McDowell had chosen the wrong option. He said there was a run available on the outside of FIERY TART and that Mr McDowell had in fact disadvantaged his own horse by hitting the marker pegs. He said FRANCO TEMPLAR had not gained an advantage.
--The issue we identify as being whether FRANCO TEMPLAR gained an advantage over the horses that finished 5th or 6th by taking the inside run. There is no suggestion that FRANCO TEMPLAR interfered with the chances of any other runner.
--While it is clear there has been a beach of rule 869(7A)(b), we are not satisfied that a run was not available on the outside of FIERY TART. FRANCO TEMPLAR clearly finished better than the horses that finished 5th and 6th and the margins were considerable; 3 lengths to 5th and a further 2 lengths to 6th. We are satisfied that by taking what is clearly the wrong option, Mr McDowell did not obtain a clear run to the winning post that he would not otherwise have been able to obtain had he moved to the outer of FIERY TART. In these circumstances, we exercise our discretion and dismiss the protest.
