Placings and dividends were confirmed as being as the horses crossed the line.

Facts:

Mr Allison, stipendiary steward, alleged that with approximately 100 metres to run PRINCESS DELIGHT (A Sanderson), which finished 1st, shifted ground outwards impeding GRACEANDTEMIKA (B Williamson), which ran 3rd.

The Judge’s placings were:

1ST  9 PRINCESS DELIGHT
2ND 1 CHERYL WEST
3RD 2 GRACEANDTEMIKA
4TH 7 EMMALINE FRANCO

Relevantly the judge’s margins were: 1 3/4L and 1/2L. 

Submissions for Decision:

Mr Allison demonstrated on the videos that PRINCESS DELIGHT when running home along the passing lane had briefly moved out inconveniencing GRACEANDTEMIKA. He stated that PRINCESS DELIGHT was always going to win but the issue was whether GRACEANDTEMIKA would have run 2nd.

Mr Williamson gave evidence that GRACEANDTEMIKA was making progress up the straight when receiving interference. When questioned as to whether CHERYL WEST had not started to pull away from GRACEANDTEMIKA, he said he lost some momentum at the time. He agreed that once GRACEANDTEMIKA had recovered from what was only a slight check he did not improve on CHERYL WEST after that.

Mr Negus, the trainer of GRACEANDTEMIKA then stated that now having viewed the videos a number of times he believed there was some doubt GRACEANDTEMIKA would have run 2nd.

Reasons for Decision:

Mr Allison then sought and was granted leave to withdraw the protest.
