Mr Thornley has admitted a breach of R 869(2)(a) in that he used his whip approximately 19 times without a discernible pause in the run home whilst driving JUMANGI FRANCO, which the stewards deemed to be excessive.

Mr Ydgren has demonstrated on the video that in race 6 Mr Thornley has used the whip some 19 times on JUMANGI FRANCO in the last 200 metres. It is a quick fire action with little if no respite.

Mr Ydgren has submitted that a penalty of $200 is appropriate. He has produced Mr Thornley’s record, which shows 2 breaches of the whip rules in the past year. One breach was excessive use on 30 December 2009, when a fine of $200 was imposed, and the other was using the whip outside the confines of the sulky on 9 October, when again a fine of $200 was imposed.
Reasons for Penalty:
The penalty has to reflect Mr Thornley’s repeated breach of this rule.
