After race 4 Mr Allison, assistant stipendiary steward, instigated a protest into the 4th placing of J C?S SUPRIMA alleging interference at the 2000 metre mark to STOUT MURPHY placed 11th by the Judge. He sought relegation to behind STOUT MURPHY. Judge's placings were 13, 9, 2, 4, 5, 7.

Mr Allison had the stipendiary steward Mr Knowles demonstrate on the videos that at approximately the 2000 metre mark J C?S SUPRIMA forced LAURA LANE on to STOUT MURPHY with that horse running over 2 marker pegs, breaking and losing all chance.

Mr Knowles stated that J C?S SUPRIMA was 3 wide entering the turn and was hanging. Mr Barclay was attempting to keep the horse out but the interference occurred despite his efforts. Mr Barclay confirmed this, stating he did not believe there had been contact but agreed that STOUT MURPHY had broken as a consequence of the general tightening. Mr Soroka agreed with Mr Barclay.

Despite Mr Barclay's efforts it is clear that interference was caused to STOUT MURPHY as a consequence of LAURA LANE being forced down onto that horse through the hanging of J C?S SUPRIMA which was racing on the outside of LAURA LANE. In exercising my discretion and relegating J C?S SUPRIMA under rule 869(8)(b) I find that J C?S SUPRIMA gained an advantage by interfering with the progress and chances of STOUT MURPHY.
