Mr Knowles instigated a protest under rule 869(8)(b) against the 3rd placing of TELLALIE in race 5 on the grounds that after approximately 400 metres TELLALIE moved inwards onto THE WAY FORWARD which moved inwards on to WHATA LEGACY causing that horse and ELUSIVE KATE to break and lose their chances.
| -- Mr Knowles instigated a protest under rule 869(8)(b) against the 3rd placing of TELLALIE in race 5 on the grounds that after approximately 400 metres TELLALIE moved inwards onto THE WAY FORWARD which moved inwards on to WHATA LEGACY causing that horse and ELUSIVE KATE to break and lose their chances. --Mr Knowles demonstrated on the videos that as the horses left the back straight TELLALIE came across onto THE WAY FORWARD when not sufficiently clear. As a consequence that horse moved inwards on to WHATA LEGACY causing that horse and also ELUSIVE KATE to break and lose their chances. Mr Harrison, the driver of THE WAY FORWARD stated that he was forced to take hold of his horse when TELLALIE came across in front of him. His horse then ran away from TELLALIE tightening WHATA LEGACY. He added that there was no contact but it was fortunate his horse did not break. Mr Williamson, driver of WHATA LEGACY, stated he was tightened down onto the markers and after being forced to take hold of his horse it broke as a result of running over the pegs. He said the pressure was from his outside. When questioned, he said he was not sure as to the source of that pressure. --Mr Walkinshaw stated although he may have moved inwards slightly he did not believe there was any contact between TELLALIE and THE WAY FORWARD. Mr Negus stated that TELLALIE had a tendency to run in, and he was contemplating a gear change, and also emphasised there had been no contact. He was forthright in his comments and accepted that if his horse had caused the interference to WHATA LEGACY then it should be relegated. --I am satisfied from the videos and the oral evidence that TELLALIE did come across when not clear of THE WAY FORWARD, forcing the Mr Harrison to quickly take hold of his horse and as a consequence it moved down onto the line of WHATA LEGACY. In exercising my discretion and relegating TELLALIE to behind WHATA LEGACY I am satisfied that TELLALIE caused interference which resulted in WHATA LEGACY breaking and as a consequence losing all chance. The progress and chances of WHATA LEGACY were clearly affected by TELLALIE and the protest is upheld. The amended placings are --1st 5 FRANCO SOLITAIRE --2nd 9 NICKY?S DIAMOND --3rd 11 JAYEES ALBERT ----
