Decision: Following the running of race 8, the Harvey Norman Handicap Pace, a protest was instigated by Stipendiary Steward Mr C Allison, alleging horse no. 4, BROWNIE POINTS, driven by Mr R M Tither, broke in excess of 150 metres at the start.

The connections of BROWNIE POINTS were represented by Mr G Anderson and driver Mr R M Tither.

Stipendiary Steward Mr P Knowles showed video footage of the start of the race, identifying BROWNIE POINTS galloping off the mark from both head on and side on camera angles.

The side on film shows BROWNIE POINTS galloping past the marker, surveyed at being 150 metres from the 2700 metre stand start point.  BROWNIE POINTS is observed to continue in a gallop for at least 20 metres past the marker before it settles into a pace.

Mr Anderson contended that some consideration should be given to the fact that BROWNIE POINTS was the red hot favourite and that it had not gained an advantage.

Applying the Breaking Horses Regulation and Rule 870 (3) the protest is upheld and BROWNIE POINTS disqualified.
