Decision: Mr B E O’Connor admits a breach of Rule 862 (2) following an information laid by Stipendiary Steward, Mr C J Allison, alleging that in Race 3, the Dunedin City Ford Mobile Pace, Mr O’Connor, driver of TANIQUE, started from the incorrect barrier position,

Mr B E O’Connor admits a breach of Rule 862 (2) following an information laid by Stipendiary Steward, Mr C J Allison, alleging that in Race 3, the Dunedin City Ford Mobile Pace, Mr O’Connor, driver of TANIQUE, started from the incorrect barrier position, impeding REALEIZ TYME, driven by Mr A W Faulks.

shows Mr O’Connor manoeuvring into the 3 position on the second line, when he in fact had drawn 4.  Mr Faulks is seen to be unable to get into his rightful slot and is clearly hampered at the dispatch.

Mr Allison pointed out that there had been a false start and that this breach occurred on the second attempt.  This may have caused an element of confusion on the part of Mr O’Connor as to where his rightful barrier position was, given that the horse on the front line had now been placed on the outside of the front line, thereby putting the horse Mr O’Connor had been originally following, one position closer in.

Mr O’Connor accepts he is solely responsible under the rule, however he felt the starter should have played some part in getting the reassembled field in the correct positions.

In assessing penalty, Mr Allison stated Mr O’Connor has no previous breaches of this rule and that a fine in the vicinity of $200 was appropriate in line with other recent breaches.

Mr O’Connor had no objection to a fine.

Accordingly, taking into account Mr O’Connor’s guilty plea, no previous breaches and a set of circumstances which contained some mitigating factors, a fine of $150 is imposed.
