Decision:

The best video angle did not demonstrate that LADIES MILE was in her correct gait at the time FLYIN SUE stepped out forcing SANDRA KEITH to move wider on the track and into the position behind the mobile that LADIES MILE was moving up to occupy. The last conclusive frame, which was only a stride from the interference, evidenced that LADIES MILE was still not in her correct gait.

The Stewards were thus advised that there was no conclusive evidence to establish LADIES MILE had been denied a fair start.

Facts:

Mr Ferguson sought a ruling pursuant to r 213(1)(j) as to whether LADIES MILE was denied a fair start in race 4, the SPEIGHTS FILLIES & MARES MOBILE PACE 2YO+ C0 2200 metres.

That rule provides:
213(1) A Stipendiary Steward at any time may scratch from a race … any horse on all or any of the following grounds:
(j) if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.

Submissions for Decision:

Mr Tidmarsh showed the various video angles of the run up behind the mobile at the start. He made no comment other than to identify both the various video angles that were available and the horses involved.

LADIES MILE, which had drawn 7, although there was a scratching to her inside, was pacing and then skipping in the score up. As LADIES MILE came up to the mobile FLYIN SUE, which was 2 inside LADIES MILE, came out and interfered with SANDRA KEITH, which was to the immediate inside of LADIES MILE and LADIES MILE was forced to take evasive action. LADIES MILE galloped at this time. None of the angles were conclusive as to whether LADIES MILE was in her correct gait at the time FLYIN SUE stepped out.

The Committee asked Mr Ferguson to comment on whether LADIES MILE was in her correct gait when SANDRA KEITH forced the horse to move wider on the mobile. Mr Ferguson was uncertain as to this and agreed the videos were inconclusive. He said he thought LADIES MILE might have commenced pacing a couple of strides prior to the interference.

Reasons for Decision:

There is only one video angle that is of assistance and that shows that LADIES MILE was not in her correct gait at the point she is one stride from her receiving interference and being forced to change direction as SANDRA KEITH shifts out. It is impossible to tell whether the horse had returned to a pace. The video evidence does not demonstrate this and Mr Ferguson has frankly acknowledged he was not certain whether the horse was pacing or skipping at the time.
