Having regard to this case and the fact no horse was denied a start as a consequence of the breach, Mr Taylor is fined the sum of $200.

Facts:

Mr Wallis, Stipendiary Steward, alleged that Mr Taylor failed to give notice to the Secretary of the Club that NOMATTERME was to be scratched by the official right of re-entry time.

Rule 834(1) provides: “Any person intending to scratch a horse from a race after it has been deemed to have accepted therefore, shall give notice to the Secretary of the Club to that effect before the official scratching time which shall also be the official right of re-entry time for any race meeting.”

Mr Taylor admitted the breach and indicated on the information that he did not wish to be present at the hearing.

Mr Wallis explained that Mr Taylor had only notified HRNZ just after midday today that NOMATTERME was to be scratched. He said a veterinarian had examined the horse yesterday morning and had determined it was not fit to start.

Mr Taylor had said to him that he had had a busy schedule and had not scratched the horse yesterday as he thought the veterinarian certificate would have sufficed.

Submissions for Penalty:

Mr Wallis explained that the respondent’s error had not cost another horse a start in the race. There were no ballots. The starting point, he noted, in the JCA Penalty Guide was a fine of $400. He submitted that a penalty of a fine of $200 was appropriate in this case.

The Committee considered the recent case of Mr House where in similar circumstances he was fined the sum of $200 on 25 October 2015.
