----Video footage of the incident demonstrated by stipendiary steward, Mr Knowles, shows Mr Davis striking his horse approximately 25 times in the final 200 metres. The use of the whip is continuous.
----In explanation Mr Davis conceded his use of the whip was excessive and he had considered this to be the case when he analysed video footage of the race himself. In mitigation he stated that although the incident looked bad and that public perception of it would not look good, the horse itself was unmarked from the experience and that it had not been hit that hard. When driving DOCTOR MCCOOL at his previous start Mr Davis stated that he had stopped driving with the whip and the horse "closed up". He added DOCTOR MCCOOL will respond when driven vigorously and has to be hit with the whip to respond.
----In his submissions as to penalty, Mr Knowles suggested that a fine in the vicinity of $300 would be appropriate given that Mr Davis had been fined $200 for a similar offence two months ago.
----We take into account Mr Davis' explanation and his frank admission of the breach, but balance this against the fact that Mr Davis has a previous, recent breach of the rule at Akaroa. A fine of $300 is imposed and we remind Mr Davis of his obligations under the rules of harness racing.
----Two breaches of the rule in two months are two breaches too many.
