Facts:
Following the running of Race 8, the SPEIGHTS MOBILE PACE an information was filed by Stipendiary Steward Mr S Renault alleging Mr R Close (Sioux Nation) breached Rule 869 (3) (b) in that Mr Close ”...allowed Sioux Nation to improve inwards and force Rockefeller to race over pylons and break.”
Mr Close admitted the charge and attended the hearing assisted by Mr N Williamson.
Rule 869 (3) (b) reads:
(3) No horseman in any race shall drive:-
(b) carelessly.
Mr Wallis, with the use of the videos, outlined the relevant positions of both Sioux Nation and Rockefeller as the field approached the 1600m mark. Sioux Nation (R Close) was trailing in fifth position in single file before shifting outwards about the 1700m mark into a one-out three back position. Rockefeller (D Dunn), which had settled back early improved along the pole line. About the 1600m mark Sioux Nation shifted down to the pole line forcing Rockefeller to strike a pylon and break. Rockefeller recovered quickly and improved to a trailing position.
Mr Renault stated Mr Close had been on the pole line to begin with, had shifted outwards and then shifted back down. He had looked to his inside before moving down but when he did Rockefeller was up inside him.
Mr Close stated when he looked to his inside Rockefeller was not there. His horse was slow to move down and in that time Rockefeller had got inside him. He said no contact had been made with Rockefeller.
Mr Williamson stated that just prior to Mr Close shifting downwards the one-out line had eased with the forward hose coming back onto Sioux Nation. This had caused Sioux Nation to lose some momentum. When Mr Close shifted downwards he noted that Mr Dunn had made no attempt to ease his horse. The committee should take into account there are mitigating factors involved.

Mr Renault said Mr Close had a clear record this season. He had had 258 as a Junior Horseman. He had one previous breach of this Rule at Cambridge on the 7th May and was fined $250. This was his second breach within a month. The recommended Penalty Guide for a second offence was a 3 day suspension.
Mr Close stated he had three to four drives per meeting and had a lot of drives coming up. He had admitted the charge at the outset and cooperated with the Stewards. He made no specific submission on penalty.
Reasons for Penalty:
Mr Close was given credit for his early admission of the breach and his Junior Horseman status. The committee also took into account the mitigating factors of the incident, lower end of the scale and no horse lost its chances. The aggravating feature is that this is Mr Close’ second offence of the same Rule within a month. The starting point for a second offence is a three day suspension. We have reduced the penalty one day for Mr Close’s early admission and the factors in the incident which were at the lower end of the scale. We believe a two day suspension is appropriate. In setting dates we have taken into account that Mr Close would probably not be driving on Jewels Day (May 30th).
