Facts:

Following the running of Race 7, the JUST ESSENCE CATERING PACE an information was filed by Stipendiary Steward Mr S Renault alleging a breach of Rule 862 (2) in that Mr A Beck (Rattling Thunder) “...allowed Rattling Thunder to start from its incorrect barrier position.

Mr Beck admitted the charge and attended the hearing.

Rule 862 (2) reads:

(4) No horseman shall permit a horse to start and no horse shall start other from its correct barrier position or in advance of its barrier position (either at a stand or mobile start, unless directed by the Starter in accordance with Rule 860 (8).

Mr Wallis, with the use of the video, pointed out the relevant position of (Rattling Thunder) prior to the start. The race was a standing start and (Rattling Thunder) was drawn on the outside of the second line.

Mr Renault stated Mr Beck should have lined up (Rattling Thunder) from barrier three on the second line. This would have placed him behind (Sunnivue Bay Boy) who was drawn three on the front line. However Mr Beck lined up (Rattling Thunder) from about six on the second line. He further added that (Rattling Thunder) had not gained an advantage over any other horse at the start, was slow away and settled near the rear of the field.

Mr Beck stated the trainer had advised him (Rattling Thunder) was very fractious from a stand and to keep him moving as long as possible up to the start. He had started wider out to give himself a bit more room. He had not been trying to gain an advantage.

Submissions for Penalty:

Mr Renault said Mr Beck had a clear record under this Rule this season. He had had 283 drives to date this season. The Penalty Guide recommended a starting point of a $400 or eight drives suspension. A similar fine for this Rule was at Addington in a Group race ($250). He was seeking a minimum fine of $200 to $250.

Mr Beck requested the committee consider a suspension or a fine.

Reasons for Penalty:

Mr Beck is given credit for his early admission of the charge and his excellent record. The only aggravating feature of this incident is starting from the incorrect barrier position. No advantage was gained and no other horses were inconvenienced at the start. The committee considered a suspension but believe a suspension for this offence, considering the low scale of the offence, would be an unduly excessive penalty. A fine at the lower end of the scale is appropriate.
