Facts:
Following the running of Race 6, the PRYDES EASIFEED TROT an information requesting a Ruling under Rule 213 (1) (j) was lodged by Mr AR Beck on behalf of the connections of ELTSUNAMI alleging ELTSUNAMI was “...denied a fair start when SUNNIVUE SADONA backed back prior to the tapes being released checking my horse.”
Rule 213 (1) (j) reads:
(213) (1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:
(j) if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.
Mr Wallis, with the use of the videos, pointed out the relevant positions of both Sunnivue Sadona and Eltsunami. Sunnivue Sadona drew eight on the front line and Eltsunami was in the Unruly position on the outside and back from the frontline horses.

Mr Beck argued that as the tape was released SUNNIVUE SADONA backed backwards from the front line seriously inconveniencing his horse, which never received a fair start. The interference from SUNNIVUE SADONA effectively cost him a lot of ground and put him out of the race. He was seeking the late scratching of his horse under the Rule.
Mr W Ferguson, Starter, stated SUNNIVUE SADONA had backed away from the tape prior to its release and was on the second line. After the tape was released the horse backed away again interfering with ELTSUNAMI which was further back in the unruly position.
Mr Renault stated that in his opinion the interference occurred after the tape had been released.
Reasons for Decision:
After considering the evidence the committee is satisfied that SUNNIVUE SADONA backed away from the start after the tape was released, causing interference to ELTSUNAMI on the unruly position.
