Facts:
At the conclusion of Race 1, the Forbury Park Sports Bar Trot, an Information was lodged by Mr Wallis under r 870(5) alleging that PAT THE MONKEY broke inside the final 50 metres and was lapped on to MAGIC GALLEON and SUNRISE SPUR.
Judge’s placings were:
1st - 3 MUSCLE PAT
2nd - 7 PAT THE MONKEY
3rd - 4 MAGIC GALLEON
4th - 9 SUNRISE SPUR
5th - 5 SWEET JEWELIETTE
The relevant rules and regulations provide:
870(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A) such relegation of the horse shall be at the discretion of the Judicial Committee.
Submissions for Decision:
At the request of the informant, Mr Munro, Stipendiary Steward, demonstrated on the videos that PAT THE MONKEY broke just inside the final 50 metres and galloped across the finishing line.
Mr Morrison, the driver of PAT THE MONKEY signed the information and indicated that he did not contest the protest. Mr Wallis confirmed that Mr Morrison represented the connections of PAT THE MONKEY.
Reasons for Decision:
Having viewed the videos the Committee is satisfied that just after the 50-metre mark PAT THE MONKEY has gone into a break and has continued in a gallop past the winning post. The horse was free of interference at the time. Although the available video angles are far from ideal, the distance the horse galloped is estimated to be some 48 metres.
There is no suggestion that PAT THE MONKEY suffered interference. Rule 870(5) is clear, the horse must be relegated to behind the two lapped on horses.
