Facts:

Mr Tidmarsh, Stipendiary Steward, alleged that Mr Hunter (BOLD RULER) used his whip excessively in race 9, the PINELEA FARMS MOBILE PACE, in the home straight.

Mr Tidmarsh demonstrated on the videos that the respondent on entering the home straight was held up for a run. He then pulled the removable deafeners and the sliding blinds before using his whip 13 times in the final 200 metres. He acknowledged there were a couple of “minimal pauses”, but Mr Hunter’s actions were clearly in breach of the rule.

Mr Hunter accepted Mr Tidmarsh account of events and confirmed he had paused briefly a couple of times.

Submissions for Penalty:

Mr Tidmarsh submitted that a fine of $300 was appropriate. He said the respondent had an exemplary record. He had had 38 drives this season prior to tonight and 165 the last. His record was clear under all rules.

Mr Hunter asked for a fine rather than a suspension.

Reasons for Penalty:

Mr Tidmarsh is correct when he says that there were some very brief pauses in Mr Hunter’s whip action, but the number is clearly in excess of 10 strikes. As Mr Hunter said, it will take time to adjust to the new guideline, although he personally was in favour of it.
Mr Hunter is given credit of $100 for each of the mitigating factors of the admission of the breach and his excellent record.
