As the breach was admitted we find the charge proved.

Penalty:

Mr Cox was fined the sum of $250.00 and was suspended from driving from the conclusion of racing on Saturday the 23rd April 2011 until the conclusion of driving on Tuesday the 27th April 2011 effectively one South Island racing day.

Charge:

At the conclusion of race 6 the Brylin Boyz Handicap Trot an information was lodged by Stipendiary Steward (Mrs K Williams) alleging that JW Cox (GRANT US PEACE) used his whip in an unnecessary manner with 150m to run.
Mr Cox admitted the breach.

Facts:

Stipendiary Steward Mrs Williams showed the committee several video clips of the alleged incident highlighting Mr Cox (GRANT US PEACE) using his whip in an unnecessary manner with 150metres to run.

Mrs Williams stated that Mr Cox had an obligation under the rule to drive his horse out but on this occasion he has struck his horse (GRANT US PEACE) in the home straight twice in front of the public after the horse had lost it's gait.

Mr Cox agreed with Mrs Williams’s statement.

Mrs Williams stated that Mr Cox had one previous breach under this rule at the Winton Harness Meeting on the 17th April 2011 where he received a fine of $200.00.

Mr Cox stated that he had some driving commitments at the Timaru Harness Meeting on Tuesday the 26th April 2011 and that he had commitments with Jaccka Jack at the up and coming meeting in Canterbury on Friday the 29th April 2011.

Reasons for Penalty:

The committee was satisfied that a breach of the rule had occurred and on this occasion it appeared that Mr Cox had showed his disappointment by striking GRANT US PEACE when he broke in the home straight when he possibly may have gained a stake bearing place.
