The Committee ruled that ARDEE TROUBLE had not been denied a fair start and advised the Stewards accordingly.
ARDEE TROUBLE was not late scratched by the Stewards.
Facts:
Mr Munro sought a ruling pursuant to r 213(1)(j) in race 3, the Forbury Park Junior Drivers Handicap Trot as to whether ARDEE TROUBLE was struck by the tapes after rearing at the start and was thereby denied a fair start.
That rule provides:
213(1) A Stipendiary Steward at any time may scratch from a race … any horse on all or any of the following grounds:
(j) if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.
Submissions for Decision:
Mr Munro played the video of the start of the race. Head-on, side-on and back straight angles were viewed. These demonstrated that ARDEE TROUBLE bounded into the air as the tapes were released with the tape contacting the gelding's legs. ARDEE TROUBLE then trotted for several strides before breaking.
The Committee heard from Ms Lewis and Mr White.
Ms Lewis said ARDEE TROUBLE was fired up and was on edge before the start and the tape hitting the horse’s legs did not help.
Mr White said the tape had wrapped itself around the legs of ARDEE TROUBLE and that was why it had galloped. He believed this had put ARDEE TROUBLE into panic mode and the horse had tried to jump the tape. He said ARDEE TROUBLE had not missed away before. He accepted ARDEE TROUBLE had trotted away briefly but believed there had been a roll on effect from the tape and that was why the horse broke after a few strides.
Reasons for Decision:
ARDEE TROUBLE is clearly fractious before the start of the race and as the tapes are released the horse bounds in the air. The front legs of the horse come into contact with the tape. Significantly, ARDEE TROUBLE then trots away and takes some four or five strides before galloping. In these circumstances it cannot be said that clearly the cause of the horse galloping is the fact that the tape has struck the legs of the horse.
