We find the breach proved. 

Penalty:

We fine the defendant the sum of $225 and ask the stipendiary stewards to remind the defendant of his obligations. As a senior horseman he should have known not to continue to use the whip in the manner that he did even though the horse was giving. 

Charge:

Mr Allison, stipendiary steward, alleged that Mr J Bond, the driver of BIG ROCKET used his whip excessively in the run home. 

Facts:

Mr Allison demonstrated on the video that as he turned for home Mr Bond commenced to use the whip. He counted some 27 strikes from that time until the horse crossed the line. He acknowledged that the horse fought on well for 2nd placing, but was concerned the strikes were continuous in the last 200 metres.

Mr Bond admitted the breach.

Mr Allison produced the defendant’s record, which showed no breaches in the previous 12 months.  He described the breach as being above the lower end.

Reasons for Penalty:

We are satisfied that the defendant has used the whip some 27 times although we note a couple of these were on the shaft. His actions were continuous over the last 200 metres.  We have regard to the defendant’s excellent record in respect of this rule and his admission of the breach.
