In these circumstances r 870(5) requires us to relegate FLURRY to behind LOXI CLAIRBORNE.

Amended placings are:

1st 2 ITS ELVIS
2ND 7 DANIELLE AMORE
3RD 3 LOXI CLAIRBORNE
4TH 10 FLURRY
5TH 4 SPUR WING

Stakes and dividends are to be paid accordingly.

Facts:

At the conclusion of Race 1, the JUST ESSENCE HANDICAP TROT, an information was lodged by Mr McIntyre under r 870(5) alleging that FLURRY was in its incorrect gait crossing line and was lapped on by the 4th placed horse, LOXI CLAIRBORNE.

Judge’s placings were:

1st 2 ITS ELVIS
2ND 7 DANIELLE AMORE
3RD 10 FLURRY
4TH 3 LOXI CLAIRBORNE
5TH 4 SPUR WING

The official margin between 3rd and 4th was a head.

Rule 870(5) states:

Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.

Submissions for Decision:

Mr McIntyre demonstrated that FLURRY, when mounting a run down the outside of the track, galloped inside the final 20 metres. The driver took hold and FLURRY lost ground. FLURRY was lapped on by LOXI CLAIRBORNE.

Mr Williamson, the driver of FLURRY, represented the connections of the horse, and indicated on the information that he did not contest the protest.

Reasons for Decision:

We are satisfied that FLURRY galloped just prior to the winning post and was not in its correct gait when it crossed the finishing line. The horse, which had not suffered interference from any other runner, was lapped on by LOXI CLAIRBORNE.
