Mr Dance admitted a breach of rule 849(2) in that he presented LADY GWENAVERE in the birdcage in race 3 with the incorrect saddlecloth number. I thus find the charge proved.
--Mr Knowles explained that the error had been detected as the horse went out on to the track and he sought a fine of $100. Mr Dance said by way of explanation that he had horses in 2 races and he obtained the wrong number. He said that no attendant was present in the numbers room and that he had no racebook to look at to ensure he had the right number. I am aware that $100 is the “standard penalty” for this minor breach of the Rules. Mr Dance has no previous breach of this rule. While the onus is on the trainer to ensure that the right saddle cloth is used, I am concerned that there was no attendant present. Having regard to this fact and Mr Dance’s excellent record, it is appropriate on this occasion to halve the usual penalty. Mr Dance is fined the sum of $50.
