Facts:
Following the running of Race 4, the RODNEY MOORE MEMORIAL HANDICAP PACE, an information was filed by Stipendiary Steward, Mr Renault, alleging that Mr Williamson, the driver of POCKET CALL, used his whip on more occasions than is permitted by the Use of the Whip Regulations.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.
The Use of the Whip Regulations provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Munro, Stipendiary Steward, identified POCKET CALL on the race films. Mr Renault demonstrated that the respondent used his whip 15 times. The 15 strikes were interrupted by some pauses and there were 7 backhanders. POCKET CALL finished in 1st place.
Mr Williamson agreed with the count and said POCKET CALL was giving and he was getting the best out of the horse in a close finish.

Mr Renault said Mr Williamson had had 450 drives this season and 428 since his previous breach of this rule in August 2018. He submitted the starting point in the JCA Penalty Guide was a $300 fine.
Reasons for Penalty:
The number of strikes is 15, which is mid-range. Six months is the reset period under this rule. Mr Williamson has no breach of this rule in this time. His record under this rule is very good.
