Facts:
At the conclusion of Race 4, an Information was lodged by Mr Williamson under r 869A(2) alleging that the 1st placed horse, OFF THE EDGE, caused interference to the 2nd placed horse, OLIVER NORTH, in the home straight.
The margin between 1st and 2nd was a neck.
Rule 869A(2) states:
When a placed horse or its driver causes interference to another placed horse and the Judicial Committee is satisfied that the horse interfered with would have finished ahead of the horse that, or whose driver, caused the interference the Judicial Committee must, in addition to any other penalty that may be imposed, place the horse that, or whose driver, caused the interference immediately after the horse interfered with.

Submissions for Decision:
Mr Renault demonstrated on the side and head-on videos that OLIVER NORTH was tightened some 50 metres off the line and he believed Mr Williamson had had to check his horse.
Mr Williamson stated that there had been tightening because Mr Cox who was racing to his outside had shifted in but after viewing the head-on video he could see that his horse (OLIVER NORTH) had gone out a little which had made the tightening worse. He thought had there not been the tightening the finish would have been very close, but he could not say for sure that he would have beaten OFF THE EDGE.
Mr Cox said that OFF THE EDGE was hanging a touch. He had tried to correct his horse off Mr Williamson as he was aware he was shifting ground a little. He said Mr Williamson’s horse was fighting back. He emphasised that Mr Williamson had said he could not be certain he would have beaten Mr Cox. Mr Cox said he had had to take hold of his horse as well and he believed he would have beaten Mr Williamson no matter what, as his horse was finishing the slightly better.
Mr Renault stated that Mr Williamson’s horse was under a drive. Mr Cox did get in and he was inside the line of Mr Williamson at the 70 metres. Mr Williamson had had to stop driving and take a hold and he was only able to push his horse out to the line as a consequence. He agreed the head-on showed that Mr Williamson had shifted out, but he believed this was only when he was tightened. While Mr Williamson had said he could not be certain he would have beaten Mr Cox, he had said that he was robbed of a close finish. The margin at the finish was only a neck.
Reasons for Decision:
The Committee viewed the side and head-on videos. It is clear that Mr Cox has shifted in and tightened Mr Williamson late in the run home, but it is also evident that Mr Williamson has shifted out at the same time. While Mr Williamson has had to check his horse, he was quite frank in his evidence that he was not certain he would have beaten Mr Cox. He stated that he believed it would have been a close finish. Mr Cox has taken hold of his horse as well.
After viewing all the video evidence and hearing from the parties, and taking into account the neck margin, the Committee is not satisfied that OLIVER NORTH would have finished ahead of OFF THE EDGE had there not been tightening in the home straight.
