Mr Walkinshaw you?ve admitted a breach of the push out rule. Mr Jones and Mr Negus have both said on your behalf that the horse FRANCO SMOOTHIE is difficult to drive.

Mr Walkinshaw you?ve admitted a breach of the push out rule. Mr Jones and Mr Negus have both said on your behalf that the horse FRANCO SMOOTHIE is difficult to drive. Mr Negus, in addition, has said that in his belief gear changes that he made to the horse tonight may have made it respond slower than it otherwise would have, when you endeavoured to come out. Mr Jones also says that as the pace eased he moved up swiftly on your outside.

This combination of factors resulted in the breach of the push out rule that you?ve admitted. Knowing the manners of this horse Mr Walkinshaw, as you do, we observe you should have been aware of the need to exercise especial care when moving from the 2 wide to the 3 wide line. The breach has resulted in the relegation of your horse. Nonetheless, we accept that the manners of the horse contributed to the incident. This, together with your admission and clear record this season, plus you?ve had, in your estimation, 180 plus drives, leads us to impose a fine of only $150. But we emphasise the need for you to ensure that you comply in the future with the Rules of Harness Racing. Your good record has stood you in good stead this time, you cannot rely on it to do so in future.
