Under Rule 869 (3) (b) an information was lodged by Stipendiary Steward Mr P T Knowles against Mr A S Broomhall, the driver of BEAUDINE TERMINATOR, in Race 3, the Bill Beck Pace, in that Mr Broomhall drove BEAUDINE TERMINATOR carelessly, allowing the horse to strike the sulky of ENTRAPMENT,

Under Rule 869 (3) (b) an information was lodged by Stipendiary Steward Mr P T Knowles against Mr A S Broomhall, the driver of BEAUDINE TERMINATOR, in Race 3, the Bill Beck Pace, in that Mr Broomhall drove BEAUDINE TERMINATOR carelessly, allowing the horse to strike the sulky of ENTRAPMENT, driven by M Jones, causing BEAUDINE TERMINATOR to fall.

Mr Broomhall denied the breach.

Video footage shown by Mr Knowles shows the incident occurring approximately 100 metres from the finish. BEAUDINE TERMINATOR is shown to come off the back of the horse in front and appear to look for a gap between that horse and ENTRAPMENT the horse racing on the inside. ENTRAPMENT at that stage moves out marginally but BEAUDINE TERMINATOR continues to move down and into the back of ENTRAPMENT with the resulting effect that BEAUDINE TERMINATOR falls. BEAUDINE TERMINATOR is seen to be full of running at this time.

Mr Knowles contended that there was an identifiable gap, but this was never big enough for Mr Broomhall to get his horse through. Mr Knowles further stated that the incident was caused by an error of judgement on the part of Mr Broomhall.

Mr Broomhall stated that the gap he was going for closed due to the outward movement of Mr Jones' horse. BEAUDINE TERMINATOR was bolting at the time and there was no other option but to keep coming down and hope to stay up living in hope.

After considering the evidence an oral decision upholding the charge as proven was delivered, accepting the contention of Mr Knowles that the incident was caused by a combination of a keenly travelling horse, insufficient room and an error of judgement on the part of Mr Broomhall.

In assessing penalty, Mr Knowles stated that this was a high end breach of the careless driving rule and that a suspension of around four days was appropriate.

Mr Broomhall accepted the seriousness of the charge. Accordingly, Mr Broomhall is suspended from driving for four days, up to and including the 14th of September 2007.
