Mr Knowles alleged that Mr Malcolmson moved EVERTON STAR outwards with approximately 1500 metres to race forcing NICKY HANOVER (R Tither) to race wider on the track thereby breaching the "push out rule".

Mr Knowles alleged that Mr Malcolmson moved EVERTON STAR outwards with approximately 1500 metres to race forcing NICKY HANOVER (R Tither) to race wider on the track thereby breaching the "push out rule".
--Mr Knowles had Mr Allison demonstrate the incident on the 3 video views. These demonstrated that NICKY HANOVER had progressed quickly 3 wide from the rear of the field and that Mr Malcolmson had indeed moved out after the nose of NICKY HANOVER had passed his sulky wheel. Mr Tither also gave evidence to this effect, stating that he had been forced 4 wide as a consequence of Mr Malcolmson's actions. He said he called out to Mr Malcolmson to give him room but Mr Malcolmson took no notice and continued to come out. Mr Malcolmson denied the breach but in essence stated that he had been misled by the speed at which NICKY HANOVER had moved up from the rear of the field.
--I find the charge proved. Both Mr Tither's evidence and the videos clearly support Mr Knowles' allegation that Mr Malcolmson is in breach of the rule, and I regard Mr Malcolmson's comments as going towards mitigation only.
--Mr Knowles stated Mr Malcolmson had a clear record with respect to this rule. In light of the fact that Mr Malcolmson was clearly caught out by the speed at which NICKY HANOVER progressed, and taking into account his good record, I fine him the sum of $200.
