Mr Knowles, stipendiary steward, alleged that in race 5 Mr Jones drove carelessly when striking the sulky wheel of THE RISING

Mr Knowles, stipendiary steward, alleged that in race 5 Mr Jones drove carelessly when striking the sulky wheel of THE RISING (C De Filippi) rounding the final bend. Mr Jones admitted the breach and signed the information indicating that he did not wish to be present.

Mr Knowles had Mr Allison demonstrate on the videos that shortly before straightening for home Mr Jones endeavoured to move out from behind a tiring horse and, in so doing, a leg of his horse DRAG RACER came in to contact with the wheel of Mr De Filippi's cart. As a consequence DRAG RACER broke and inconvenienced 2 other runners.

Mr Jones noted on the information that he wished his "great driving record" and his "early guilty plea" to be taken into account. When questioned by the Committee, Mr Knowles indicated that Mr Jones had had some 800 plus drives this season and had not been charged with any breaches of the rules arising out of the manner of his driving. He stated he believed the breach was at the lower end of the scale and his recommendation was a fine of $300.

Mr Jones' record is truly exemplary when regard is had to the fact that he is an extremely busy horseman. I view the careless driving as being towards the lower end but regard must be had to the fact that his horse broke as a consequence of his actions and 2 other horses had their chances interfered with. Balancing these matters, plus Mr Jones' admission of the breach, I agree with Mr Knowles' recommendation on this occasion, and fine Mr Jones the sum of $300.
