We find the breach proved.
Penalty:
We impose a fine of $225 and remind Mr Larkins of his obligations under the Rules of Harness Racing.
Charge:
Mr Allison, stipendiary steward, alleged that Mr Larkins (DELIGHTFUL TACTICS) shifted ground inwards when insufficiently clear of VC DEVIL, which tightened up DENDERA (Mr Swain) causing it to break and lose its chance.
Facts:
Mr Allison demonstrated that shortly after the start and as the field was rounding the bend at the end of the home straight Mr Larkins, who was racing 3 wide, drifted in causing tightening to VC DEVIL (Mr Walkinshaw) which squeezed DENDERA causing that horse to break and lose all chance.
Submissions for Decision:
Mr Allison demonstrated that at the time of the incident Mr Larkins was slapping the horse up with the reins, especially the left hand. He said the respondent was crossing over and had obligation to be clear.
Mr Larkins expressed doubt that he was solely to blame and alleged there was “to-ing and fro-ing”. He added that there was tightening and VC DEVIL had run out and had contributed to the incident.
Reasons for Decision:
Mr Larkins admitted the breach.
Submissions for Penalty:
Mr Allison produced the respondent’s record. This was Mr Larkins’ first drive this season. Mr Allison said he generally had no issues with the respondent’s driving. He said he believed it was a case of misjudgment at this particular point in the race. He submitted a penalty at the lower end of the scale was appropriate.
Mr Larkins agreed with this submission.
Reasons for Penalty:
We do not believe any other horse contributed to the tightening. Any outwards movement from VC DEVIL was as a consequence of that horse being tightened by DELIGHTFUL TACTICS and being squeezing up against DENDERA.
We accept this breach occurred at a point on the track where incidents of this nature are unfortunately not that uncommon. In the respondent’s favour is that although this is his first drive this season, he generally has a good record, and he has admitted the breach. An aggravating feature is that the chances of DENDERA were extinguished by the respondent’s actions.
