In these circumstances we do not believe we are able to ascertain with the necessary degree of certainty that WHENDABOYSLITEUP galloped across the line. The protest is dismissed.
The Judge’s placings stand and dividends and stakes are to be paid accordingly.
Facts:
Mr Allison, stipendiary steward, alleged that in race 1 WHENDABOYSLITEUP, placed 4th by the Judge, broke over the final stages and was lapped on by SPRINGBANK RUBY when it galloped across the line. Placings were 2; 12; 11; 13; 10; 7. The margin between 4th and 5th was a neck.
Submissions for Decision:
Mr Allison read R 870(5) and demonstrated by reference to two video angles, the side-on and trackside, that in his view WHENDABOYSLITEUP had galloped a stride before the line and was lapped on by SPRINGBANK RUBY when it galloped across the line. There was no suggestion that WHENDABOYSLITEUP had galloped as a result of receiving interference. Mr Cox, the driver of WHENDABOYSLITEUP, initially indicated that he accepted Mr Allison’s view that his horse broke a stride short of the line but after viewing the videos stated he believed it was “touch and go” as to whether the horse galloped before or after the winning post.
Reasons for Decision:
There is no dispute that WHENDABOYSLITEUP was lapped on by SPRINGBANK RUBY when the horse crossed the line. The issue is when did the horse gallop. We found it impossible to determine from either video angle whether or not WHENDABOYSLITEUP galloped before, after or on the line. The difficulty being that the side-on video, which was the more helpful, appeared to be situated at some point after the post. WHENDABOYSLITEUP finished wide on the track and only came into view very close to the winning post. There was no helpful reference point visible on the video (other than the winning post itself) to assist this committee to determine whether WHENDABOYSLITEUP galloped before or on the line, or indeed immediately after crossing the line. We sought and viewed a print of the photo finish but this did not assist. We accept the photo would not necessarily always demonstrate a horse was galloping, but certainly on this occasion it was not apparent that WHENDABOYSLITEUP was in a gallop.
