Mr Knowles, stipendiary steward, alleged that Mr L R Mathieson, MASTER SAMWISE, shifted ground outwards when insufficiently clear of LORD DUFTON, (G Smith), causing that horse to break with resulting checks to other runners.

Mr Mathieson admitted the breach. I thus find the charge proved.

Mr Knowles replayed the videos and stated it was an error of judgment. In his view there was nothing malicious in Mr Mathieson's actions. Mr Mathieson stated that Mr Jones, who was in the trail had moved out sharply when making his run and he had simply followed him out. He stated, with hindsight, he should have remained on the inside and made his run in the passing lane.

Mr Knowles said the incident to be mid range and asked for a fine of $200 to $400. Mr Mathieson stated he preferred a suspension. Mr Knowles had no objection to this and suggested a suspension until the end of the season.

Having regard to the gravity of the breach, in that it was mid range and resulted in the relegation of MASTER SAMWISE from a dividend bearing position, Mr Mathieson's admission of the breach and his and Mr Knowles' submissions, I am satisfied that a penalty of 2 days is appropriate. Mr Mathieson is suspended from driving at the end of the meeting tonight up to and including 31 July 2007.
