This is a protest by Mr Knowles, Stipendiary Steward, against the 3rd placing of MASTER SAMWISE (L Mathieson) in Race 4 on the grounds that with approximately 250 metres to run it shifted ground outwards when insufficiently clear

This is a protest by Mr Knowles, Stipendiary Steward, against the 3rd placing of MASTER SAMWISE (L Mathieson) in Race 4 on the grounds that with approximately 250 metres to run it shifted ground outwards when insufficiently clear of LORD DUFTON (G Smith) causing that horse to break with a resulting check to ART LOVER (P Court). Placings were 4, 20, 3, 14, 3, 2, 17. Mr Knowles sought the relegation of MASTER SAMWISE to behind ART LOVER. The margin between 3rd and 4th was a nose.

Mr Knowles had Mr Allison, stipendiary steward, demonstrate on the video that just after the horses straightened for the run to the finish Mr Mathieson who was 3 back on the pylons driving MASTER SAMWISE moved out looking for a run and came into contact with LORD DUFTON, causing that horse to break and move wider on the track interfering with a number of runners, including ART LOVER.

Mr Smith, driver of LORD DUFTON, stated that Mr Mathieson had angled out looking for a run and had come into contact with his horse which was tiring at the time. He said his horse had ducked out as a consequence, coming into contact with runners on his outside and eventually breaking.

Mr Court, driver of ART LOVER stated that there was a chain reaction when LORD DUFTON broke, that he was pushed 3 cart widths wider on the track than he would have wished to make his run, and that he was held up momentarily.

Mr Mathieson stated that LORD DUFTON was hanging and that it had moved in as well as his moving out. Mr Smith accepted his horse was hanging.

In response Mr Knowles emphasised that LORD DUFTON was holding its line and that contact was the result of Mr Mathieson moving out.

I am satisfied that Mr Mathieson early in the run home has moved out in breach of rule 870(8)(a) & (b) and in so doing has come into contact with LORD DUFTON. This started a chain reaction with ART LOVER being held up when endeavouring to run on and forced to race a cart width wider (not the 3 as alleged) on the track. I thus find there was interference to ART LOVER and that the cause of this interference was outwards movement from MASTER SAMWISE. In exercising my discretion to relegate MASTER SAMWISE from 3rd to 4th I have regard to the fact that the margin 3rd to 4th was only a nose and I am satisfied that the progress of ART LOVER was interfered with at a crucial stage of the race.
