Mr Knowles, stipendiary steward, protested against the 2nd placing of HILARY in race 11 on the grounds that with approximately 60 metres to run the horse broke free of interference and failed to regain its proper gait promptly thereby gaining an advantage.
----Mr Knowles demonstrated on the video by reference to the track markers that HILARY galloped in excess of 60 metres in the run home and was still galloping when the horse crossed the line. Both Mr Suddaby and Mr Roberts accepted that the horse galloped for more than 60 metres. I am satisfied that the horse is in breach of the breaking horse regulations and has as a consequence gained an advantage through failing to regain its gait promptly as required by rule 870(3) and (4). In these circumstances I exercise my discretion under rule 1003 and disqualify HILARY from 2nd place.
